          The Regular Meeting of the Marble Rock City Council was called to order with Mayor Merfeld presiding with Councilpersons Engelhardt, Hutzell, Merfeld, Wells present.  Councilman Handley arrived at 7:28 p.m.  Many interested citizens were present.  Mayor Merfeld led the Pledge of Allegiance.


          Moved Engelhardt/seconded Wells to depart from the regular agenda order to accommodate the guests.  Roll: Ayes- Engelhardt, Hutzell, Merfeld, Wells.  Absent- Handley.  Carried.


          J.R. Ackley ask why the heat was still on at the school since it was discussed at last meeting to shut it off.  Councilman Engelhardt will look into having Paul get it turned off.


          Moved Wells/seconded Merfeld to return to regular agenda order.  Roll: Ayes- Engelhardt, Hutzell, Merfeld, Wells.  Absent- Handley.  Carried.


          Moved Merfeld/seconded Hutzell to approve the agenda as presented.  Roll: Ayes- Engelhardt, Hutzell, Merfeld, Wells.  Absent- Handley.  Carried.


          Moved Engelhardt/seconded Merfeld to approve the minutes of the November 2, 2009 Regular Meeting and the November 12, 2009 Special Meeting as presented.  Roll: Ayes- Engelhardt, Hutzell, Merfeld, Wells.   Absent- Handley.  Carried.


          Moved Engelhardt/seconded Hutzell to approve the monthly reports as amended.  Roll: Ayes- Engelhardt, Hutzell, Merfeld, Wells.  Absent- Handley.  Carried.


          Moved Engelhardt/seconded Merfeld to approve the claims as presented.  Roll: Ayes- Engelhardt, Hutzell, Merfeld, Wells.  Absent- Handley.  Carried.    Total of all city claims were $36,050.25.

          Mayor Merfeld presented the Mayor’s Report: 

  1. Stated that a letter had been received from the Supervisors regarding the charge for next fiscal year law enforcement.  It will go from $3.00 to $4.00 per capita.
  2. Part 2 of the Municipal Leadership Academy will be an internet session held on January 2, 2010.  He said that the League encouraged the mayor and entire council to watch this session together.  Moved Engelhardt / seconded Hutzell that Council or Mayor can do Part 2 Internet Session at home if they wish and the City will reimburse the $25.00 charge.   Roll: Ayes- Engelhardt, Hutzell, Merfeld, Wells.  Absent- Handley.  Carried.
  3. EPJ is on hold for right now.  It could be started back up in the future.
  4. The Abstract of Votes from the Floyd County Supervisors was presented.  Moved Engelhardt/seconded Wells to approve the Abstract of Votes as presented.  Roll: Ayes- Engelhardt, Hutzell, Merfeld, Wells.  Absent- Handley.  Carried.




          Councilman Engelhardt gave an update on the River Street Bridge.  He stated that it was time to contact people that we need for property acquisitions and right of ways.  Moved Handley/seconded Merfeld to name Jerry Engelhart as coordinator for the River Street Bridge Project to finalize details as required.  Roll: Ayes- All.  Carried. 


          The Ordinance Amending the Code of Ordinances By Adding a New Chapter Requiring the Mowing of Properties within the City Limits of the City of Marble Rock was presented for final passage.  Moved Engelhardt/seconded Wells that the mowing ordinance be passed on third and final consideration.  Roll Call Vote: Ayes- Engelhardt, Handley, Hutzell, Merfeld, Wells.  Nays- None.  Absent- None.  Carried.


          Moved Engelhardt/seconded Hutzell to instruct the Clerk to contact Midwest Roofing to get a preliminary estimate on the repair of the City Hall roof.  Roll: Ayes- All.  Carried.


          Moved Handley/seconded Engelhardt to adopt Resolution 2009-18 Establishing the Accounting Procedures for the City of Marble Rock.  Roll Call Vote: Ayes- Engelhardt, Handley, Hutzell, Merfeld, Wells.  Nays- None.  Carried.  The Auditor suggested this resolution.


          Moved Handley/seconded Engelhardt to adopt Resolution 2009-19 Granting Preliminary Approval for Tax Exemptions Allowed Under the Marble Rock Urban Revitalization Plan.  Roll Call Vote: Ayes- Engelhardt, Handley, Hutzell, Merfeld, Wells.  Nays- None.  Carried.  This is for the new house built by Gary Schmidt and Cathy Kruse.


          An ordinance adopting responsibility for water service lines was presented.  Councilman Engelhardt will discuss with City Attorney.


          Other items discussed were nuisances, water rates, Beelar Street storm sewer repair, boat anchorage, powerhouse steps, and Park Board finances.


          Mayor Merfeld thanked outgoing council members Max Handley, Don Hutzell, and Tracy Merfeld for their years of service to the city.  The City wishes them the best in the future.


          Moved Handley/seconded Wells to adjourn the meeting at 8:23 p.m.  Roll: Ayes- All.  Carried.
