MARBLE ROCK CITY COUNCIL
The Regular Meeting of the Marble Rock City Council was called to order with Mayor Merfeld presiding with Councilpersons Engelhardt, Handley, Hutzell, Merfeld, Wells present. Many interested citizens were present. Mayor Merfeld led the Pledge of Allegiance.
Moved Engelhardt/seconded Merfeld to depart from the regular agenda order to accommodate the guests. Roll: Ayes- All. Carried.
Moved Handley/seconded Merfeld to return to regular agenda order. Roll: Ayes- All. Carried.
Moved Engelhardt/seconded Merfeld to approve the agenda as presented. Roll: Ayes- All. Carried.

Mayor Merfeld discussed EPJ work at the powerhouse and boat dock. Councilman Handley read from the Iowa Code the section dealing with conflict of interest for Mayor to be Supervisor. Mayor Merfeld will talk to EPJ.
Mayor and Council thanked Don Hutzell for donating the material and labor to repair/build the footbridge.
Clerk was instructed to send a thank you to the Lions Club for their $200.00 donation for street signs.
Moved Handley/seconded Engelhardt to accept Mayor Merfeld’s appointment of John Stewart to the Park Board with term ending 6.30.12. Roll: Ayes- All. Carried.
Moved Engelhardt/seconded Hutzell to give Mayor permission to advertise mobile homes for scrap. Roll: Ayes- All. Carried.
Council discussed how much the City would be paid for the property they are selling to adjoining property owners. Moved Engelhardt/seconded Handley that legal costs and any surveying required to sell property will be charges for dividing of street. Roll: Ayes- All. Carried. Each property owner will pay half of the total amount.

Ordinance Amending the Code of Ordinances of the City of
Moved Handley/seconded Engelhardt to put second reading of Ordinance Requiring Mowing on next meeting agenda. Roll: Ayes- All. Carried.
An ordinance replacing the current Animal Control chapter in the Code of the City of Marble Rock was discussed. After final approval from City Attorney, proposed ordinance will be posted so citizens can read the ordinance as a whole. Clerk was instructed to place the proposed ordinance on the agenda for the next meeting.
Memorial Park electric, water, and sidewalk were discussed. Moved Engelhardt/seconded Merfeld to have Paul get with Park Board and find out where they want electric to come in and get material to put conduit under new sidewalk for future electric service and have DeBoest jack hammer wall of foundation off. Roll: Ayes- All. Carried.
Moved Wells/seconded Handley to table depository motion to the next meeting. Roll: Ayes- All. Carried.
City dump fence and gate dispute were discussed. Moved Handley/seconded Engelhardt to turn the cost of the fence question over to Union Township Trustees to determine what costs go to the City and what costs go to the landowner and the fence should not be removed as Mr. Merfeld has said he would do. Roll Call Vote: Ayes- Engelhardt, Handley, Wells. Nays- Hutzell. Abstain- Merfeld, because part owner. Carried.
Mayor Merfeld scheduled Halloween Trick or Treat for Saturday, October 31, 2009 from 4:00 p.m. to 7:00 p.m.
Moved Engelhardt/seconded Hutzell to consent and enter into Floyd County UR-101 Economic Development District Urban Renewal Agreement. Roll: Ayes- All. Carried. This will enable Floyd County to utilize tax increment financing to make road improvements throughout the County from the increased taxable value from the wind turbines.
Other items discussed were street repair, truck parking, Enforcement Officer, nuisance updates, River St. bridge, speeding, speed bumps, blacktopping West street to Ackley Creek Park, boat dock, new pump, and Comm. Center Ordinance amendment.
Moved Hutzell/seconded Engelhardt to adjourn the meeting at 9:43 p.m. Roll: Ayes- All. Carried.
